The Pocket Pardon Strategy and the Final Corruption of the Biden Administration – Jonathan Turley 12/4/24

Below is my column in The Hill on the Biden pardon and how it might not prove as complete a protection for Hunter Biden — or Joe Biden — as the President had hoped. Ironically, the greatest protection for President Biden in continuing investigations in the influence-peddling scandal could prove that very case that he has denounced that recognized presidential immunity for matters that arise during a presidency. Nevertheless, the action confirms the suspicion that Hunter’s bizarre criminal defense strategy may have been based on the assumption that he had a pocket pardon as insurance against any losses in court.

The interim between a US presidential election and the swearing in of a new Administration has for most of our history been a non-eventful period where the outgoing Administration winds down operations and the incoming Administration ramps up new personnel before the inauguration.

The 20th Amendment to our Constitution was enacted in 1933 to reduce the “lame duck” period between election and inauguration to January 20th instead of March 4th. Increasing ease in travel and communications made such a long interim unnecessary. However long the transition period, it has been understood that with the new election came a new mandate from the American people and the “lame duck” outgoing administration was meant to quietly quack out its last few days in office without incident.

President-elect Donald Trump’s nomination of Matt Gaetz as Attorney General has consumed most of the media attention in the last week. Indeed, it seems to have sucked the oxygen out of this city. The media frenzy over Gaetz and a couple of other nominations has served to brush over an appointment that should be universally praised: William McGinley as the next White House Counsel. I had the pleasure of teaching Bill at George Washington Law School, and he is ideal for this position, particularly at this critical time in our country.

On Friday evening, August 2, Howard Lutnick, the Chairman and CEO of the Wall Street trading house, Cantor Fitzgerald, held a fundraiser populated by the super wealthy at his home in the Hamptons. The bash was to help presidential candidate Donald Trump shore up his sagging campaign coffers. Tickets went for $25,000 each or $50,000 if you wanted a photo with Trump. You could be listed on the program as a host for a mere $500,000. According to Lutnick, the event raised $15 million. According to Federal Election Commission (FEC) records, Lutnick himself was responsible for a third of that amount. He wrote out a check for $5 million to the Trump campaign the Monday after the event.

Yes, the Democrats lost, but it was much bigger than that. There are other important losses that will impact future elections.

1. Lawfare proved impotent in taking out a candidate. In fact, every new iteration of lawfare dug the losing hole deeper. All of the accusations, show trials, and prosecutorial misconduct were for naught. For the cases that remain open, the next 75 days will be interesting.

2. Name-calling lost. Almost every political slur possible was thrown at now-President-elect Trump, and none of them stuck. Name-calling only works if true.

Last night’s Univision “town hall” with Kamala Harris was billed as an exciting opportunity for “undecided Latino voters” to question and evaluate the potential next President of the United States. The corporate press release from Univision advertises it explicitly as such.

But viewers at home would have been wholly unaware that this billing was false. As I discovered, having been granted the sacred opportunity to view the event from an adjacent room on the University of Nevada, Las Vegas campus, the carefully curated “town hall” audience was actually comprised of avowed Harris supporters.
